網(wǎng)絡(luò )拍賣(mài)的若干法律問(wèn)題探析
摘 要
網(wǎng)絡(luò )拍賣(mài)的發(fā)展給傳統法律觀(guān)念和現行法律制度提出了不少需要解決的新課題，已有文獻中涉及到的有從主體的對比來(lái)認識到現有法律在主體認證方面應該予以注意的地方，從拍賣(mài)模式的不同來(lái)要求法律對網(wǎng)絡(luò )拍賣(mài)的程序給予1個(gè)明確的規定，文章作者在汲取前人經(jīng)驗的基礎上，運用較基本的已經(jīng)發(fā)展成熟的資料對網(wǎng)絡(luò )拍賣(mài)的問(wèn)題進(jìn)行分析，認為出賣(mài)者與買(mǎi)受者之間的關(guān)系相當于傳統的買(mǎi)賣(mài)關(guān)系，由此又導致出對網(wǎng)絡(luò )平臺提供商的責任應該按過(guò)錯來(lái)追究的結論。

Abstract
Nowadays the development of Auction-on-line brings a lot of new legal problems and challenges to traditional legal system. We should pay more attention to the authentication of the main body and should give an explicit stipulation to the procedure. Based on studying the others` experiences, the thesis author uses some useful materials to analyze the problems in the topic and thinks that the relations between the sellers and the buyers are equal to the traditional business relations. Therefore the thesis draws the conclusion that as a criterion of liability, fault liability should be applied to ISP.
